All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing California Law. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

We are committed to protecting your privacy. Authorized employees within the company on a need to know basis only use any information collected from individual customers. We constantly review our systems and data to ensure the best possible service to our customers. This website may collect certain information about your visit – such as the name of the internet service provider and the internet protocol (IP) address through which you access the internet, the date and time you access the site, the page(s) that you visit while on the site, and the internet address of the website from which you linked directly to this site.

Nexgrill is the sole owner of the information collected on this website. Nexgrill does not (or will never) sell, share or rent this information to others in ways different from what is disclosed in the privacy statement below. This information is used only to administer this website, analyse trends and to generally help improve this site, and will never result in your receiving of spam e-mails.

Confidentiality

Client records are regarded as confidential and therefore will not be divulged to any third party, other than our affiliates and, if legally required to do so, to the appropriate authorities. We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by this Company will only be in connection with the provision of agreed services and products. Customer details will be stored by Nexgrill separately from card details which are entered by the client on PayGate’s secure site.For more detail on PayGate refer to www.paygate.co.za.

Exclusions and Limitations

The information on this website is provided on an “as is” basis. To the fullest extent permitted by law, this Company:

  • excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or the Company’s literature;
  • disclaims the implied warranty of merchantability and the implied warranty of fitness for a particular purpose; and
  • excludes all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or whether or not you have advised this Company of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.

Payment

Company accepts Visa and Master Card. Card transactions will be acquired for Nexgrill via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the
website. Users may go to www.paygate.co.za to view their security certificate and security policy. The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is
South African Rand (ZAR). Nexgrill takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website,
customer service and support, dispute resolution and delivery of goods.

All goods remain the property of the Company until paid for in full. We reserve the right to seek recovery of any monies remaining unpaid. In collection cases only, you shall be liable for any and all additional attorneys’ fees and court costs. Consequently, all bookings and/or transactions and agreements entered into will cease with immediate effect until such time as any and all outstanding monies are recovered in full.

Cancellation Policy

Notice of cancellation at least 1 business day prior to shipment is accepted. Notification of cancellation need to send via email to serviceSA@nexgrill.com.

Return and Exchange:

If you are returning your order in new, unused condition, contact us within 30 days from receipt. Refund will be processed when the item is received in good condition (unused). Shipping charges are not refundable. If you have a return and exchange due to shipping error, defect, or damage, contact us within 48 hours from receipt for a no-charge pickup. If damage or defects are only reported after 48 hours, it is reasonable for the seller to determine that the damage was caused post-delivery. A copy of the invoice / packing slip, along with RGA number, must accompany all returns (Refer to Return Instructions section). A replacement item will be shipped to you once the returned item has been received. Please retain the packing list as a receipt; and also as documentation for potential returns. 

Return Instructions:

  • Contact us via email at ServiceSA@nexgrill.com to request Return Goods Authorization (RGA) form
  • After you have submitted your return goods request to one of our friendly staff members will contact you to confirm arrangements.
  • We encourage you to return your parcel via Value Express courier services, as all returned parcels remain the responsibility of the purchaser until received by Nexgrill.
  • Include original packing slip, tape box securely
  • Clearly print RGA number on outside of the box

You will be notified of the status of your exchange or refund via email.

Availability

Unless otherwise stated, the services featured on this website are only available within South Africa. All advertising is intended solely for the South African market. You are solely responsible for evaluating the fitness for a particular purpose of any downloads, programs and text available through this site. Redistribution or republication of any part of this site or its content is prohibited, including such by framing or other similar or any other means, without the express written consent of the Company. The Company does not warrant that the service from this site will be uninterrupted, timely or error free. By using this service you thereby indemnify this Company, its employees, agents and affiliates against any loss or damage, in whatever manner, howsoever caused.

We may (or may not) use IP addresses to analyse trends, administer the site, track user’s movement, and gather broad demographic information for aggregate use. Force Majeure

Waiver

Failure of either Party to insist upon strict performance of any provision of this or any Agreement or the failure of either Party to exercise any right or remedy to which it, he or they are entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under this or any Agreement. No waiver of any of the provisions of this or any Agreement shall be effective unless it is expressly stated to be such and signed by both Parties.

General

This website is governed by the laws of South Africa and Nexgrill chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.
